I never thought I’d be writing this from a dusty porch in Migori, Kenya — where the dust sticks to your socks like regret, and the air smells like burnt maize and possibility.

Two years ago, I left Xi’an with a suitcase of baby-changing pads, a law degree from Southwest Jiaotong University, and a quiet dream: build a brand that doesn’t need to shout to be trusted. I thought the biggest hurdle would be logistics. Or language. Or getting a business license in Kenya.

Turns out, the real obstacle wasn’t on the paperwork.

It was in the eyes of the people who looked at me — and then at the white guy who walked into the same immigration office five minutes later, no appointment, no translator, no visa history — and said, “Oh, you’re here for the oil project?”

I mentioned this in Canada last week, where I was attending a trade fair for sustainable baby products. A Kenyan lawyer there, Agbomoagan, said something that lodged itself in my chest:

“Why do you preach that we should be able to move goods across Africa but not preach the free movement of human beings across Africa?”

He was talking about AfCFTA — the African Continental Free Trade Area. The agreement that lets trucks carry goods across borders with minimal checks. But a Nigerian? A Kenyan? A Chinese entrepreneur from Shaanxi? You need seven forms, three notarizations, and a local sponsor who knows someone in the Ministry.

Meanwhile, a Canadian with a laptop and a vague “consultant” title? He got a 90-day visa on arrival — no interview, no proof of funds, no translation of his business plan.

That’s the difference.

实际:我见过一位德国投资人,他只带了一封 email from his Berlin bank and a printed LinkedIn profile. He walked into the immigration office in Nairobi, smiled, and said, “I’m here to invest in solar.” He got a five-year residence permit. No translation. No notary. No consultant.

In Canada, I had to submit 14 pages of tax records, bank statements dated within 30 days, and a letter from my accountant certifying my net worth — all in English, certified by a notary public. The officer asked, “Do you have a business plan?” I said yes. He didn’t ask to see it.

The difference isn’t in the rules.

It’s in who the system assumes is trustworthy.

Agbomoagan didn’t just complain. He proposed a solution: free movement for lawyers.

“Let me move to Ghana without a visa,” he said. “Let me move to Kenya without a visa. Look at Schengen. That’s what we’re preaching for Africa.”

It’s not about privilege. It’s about professional mobility as infrastructure.

In Kenya, if you’re a foreign lawyer, you can apply for a temporary practicing certificate under the Advocates Act. You still need a local sponsor, but the process is designed for professionals — not for entrepreneurs selling baby pads.

But if you’re a small business owner? You’re treated like a tourist who forgot to pack a return ticket.

I hired a local “investment migration consultant” in Migori. She charged me $800 to help me fill out the “Investor’s Permit Application” (Form 23 under the Immigration Act). She didn’t speak French. I don’t speak Swahili. We communicated through Google Translate and hand gestures.

The next day, a British man came in. He spoke Swahili. He didn’t need a consultant. He just asked the officer, “Can I get a work permit for my tech startup?” The officer nodded. “Yes. Bring your passport and a letter from your bank.”

The system wasn’t broken.

It was curated.

I thought I needed a professional translator for my documents.

I was wrong.

I needed a local connection.

In Kenya, many immigration officers speak English — but they don’t read documents. They read context.

  • Does your name sound like someone from a country they’ve seen before?
  • Do you carry a British or American passport?
  • Do you mention “investment” or “development”?
  • Do you say “I’m building a brand” — or “I’m setting up a manufacturing unit”?

I changed my pitch.
Instead of “I sell portable baby-changing pads,” I said, “I’m introducing a low-cost, eco-friendly maternal care product to support rural health centers.”
I didn’t change the product. I changed the narrative.

The officer didn’t ask for a translator. He asked: “Have you partnered with any local NGOs?”
I said yes — even though I hadn’t yet.
I added one next week.

That’s the game.

Translation isn’t about language.

It’s about cultural fluency.

I spent months stressing over document checklist errors.
I worried about whether my notarization was stamped correctly.
I feared the day I’d be turned away at the airport.

Then I met a Nigerian woman in Nairobi who’d been trying to get a business permit for three years.
She had a UK degree, a clean record, and a $20,000 investment.
She didn’t have a local sponsor.
She didn’t have a translator.
She didn’t even have a fixed address.

She slept in a hostel.
She came to the immigration office every Tuesday.
She brought tea for the clerks.

Last month, she got her permit.

I asked her: “Why didn’t you hire a consultant?”
She smiled. “Because I didn’t want to pay someone to do what I could do myself — if I just kept showing up.”

That’s the difference in mindset.

In China, we’re taught: follow the rules perfectly, and you’ll be rewarded.
In Kenya, I learned: show up consistently, and you might be allowed to play.

📌 FAQ

Translation by [Your Name]”

Q2:Migori

Local Authority Permit

但他们开始叫我 “Mama Circe” — 不是 “the foreign lady” — but “Mama.”

That’s the visa I didn’t know I was applying for.
